Terms of Service for Halftone Maker

1. Acceptance of Terms

By accessing or using the Halftone Maker ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is intended for individuals who are sixteen (16) years of age or older. Do not access or use the Service if you are under 16. If you are under the age of majority in your jurisdiction, you may use any paid features only with the consent of your parent or legal guardian, who is responsible for your activity and purchases.

2. Usage Rights

The content generated by the Service ("Output") may be used for any purpose, including commercial use, without attribution, subject to applicable law and third-party rights. You may use, modify, reproduce, distribute, and display the Output.

This Section covers rights in generated Output only. It does not permit account sharing. Access to the Service is licensed per individual as set out in Section 4.1.

3. Intellectual Property

The halftone process used in this tool is a universal, standard technique. We claim no intellectual property rights over the Output. The Output created using this Service belongs to you.

While the Service itself is protected by applicable copyright and intellectual property laws, the images you create are your property.

You retain ownership of any content you upload, including images used with the Background Remover. By uploading, you grant us and our subprocessors (including Supabase) a limited license to host, transmit, and process your content solely to operate the Service and the Background Remover feature (e.g., storing images in Supabase Storage and providing time‑limited signed URLs for processing). We do not use your images for marketing or promotional purposes. You acknowledge that fal.ai may process your images under its own terms and privacy policy (which may include retention and use for service improvement); please review fal.ai’s terms and privacy policy before using the feature.

3.1 Default Sample Artwork

The default images provided in the Service include artwork from artists (used with permission). These default artworks are provided solely for feature preview purposes. Commercial use, reproduction, or redistribution of these default sample artworks is strictly prohibited. All rights to these artworks remain with their respective creators.

4. Service Model and Modifications

While this tool is currently free to use, some features may become premium in the future. The service model and features are subject to change without prior notice.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including availability of features, without any liability or obligation to users.

4.1 Accounts and Authentication

• Account. Some features require an account. Authentication is provided via Supabase; by registering you authorize Supabase to process your account data under its terms and privacy policy.
• Age Restriction. Accounts are available only to individuals 16 years and older. We may suspend or terminate any account we believe is used by someone under 16 and delete associated data as appropriate.
• License. Subject to these Terms and payment of fees, we grant a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for personal or internal business purposes.
• Single-User. Each account (and any paid plan) is for one natural person only. Do not share credentials or allow others to use your account. Accounts are non-transferable. For organizations, each individual must have their own account or seat (where available). Seats may be reassigned only for permanent staffing changes.
• Security/Enforcement. Keep your registration information accurate and your credentials secure. We do not store plaintext passwords. We may require MFA, limit concurrent sessions/devices, and suspend or terminate accounts for violations.

4.2 Fees, Subscriptions, and Payments

• Payment Processor. Payments are securely processed by Stripe. Your credit card details are submitted directly to Stripe and are never received or stored on our servers. By purchasing, you authorize Stripe to charge your selected payment method for the applicable fees, taxes, and any conversion/processing costs.
• Auto-Renewal. Subscriptions renew automatically at the end of each billing period (monthly or annually) unless you cancel before the renewal date.
• Cancellation and Refunds.
  • You may cancel your subscription at any time from your Account page.
  • If you cancel within 14 days after the charge date (for either monthly or annual billing), you may request an immediate cancellation and a pro rata refund for the unused portion of your subscription. Refund eligibility and processing are managed via your Account page.
  • Outside this 14‑day window, cancellation takes effect at the end of the current billing period, and fees are non-refundable except where required by law.
• Downgrades and Plan Changes. Changes to your subscription plan (including downgrades) take effect at the end of the current billing period. Until then, your existing plan remains active.
• Taxes. Depending on your jurisdiction, additional taxes (such as VAT or sales tax) may apply. You can review the tax-inclusive final price at the checkout page before confirming payment.
• Failed or Invalid Payments. Failed, declined, or reversed payments may lead to immediate suspension or downgrade of your access until valid payment details are provided.

4.3 Third-Party Services (Supabase, Stripe, and fal.ai)

The Service integrates third-party services, including:

• Supabase (authentication, database, and storage),
• Stripe (payments), and
• fal.ai (image processing for the Background Remover).

For the Background Remover, we store your uploaded image temporarily in Supabase Storage and provide a time‑limited, signed URL to fal.ai, which accesses the image to perform background removal and returns the processed result. We delete the uploaded image from our storage promptly after processing completes. The processed result may be saved to your account for your convenience.

fal.ai may retain copies of images and use them for service improvement and AI model development, and may disclose them to third parties when required by law, under its own terms and privacy policy. We do not control fal.ai’s independent processing. Your use of fal.ai via this feature is subject to fal.ai’s terms and privacy policy in addition to ours.

We may share limited data with these providers as described in our Privacy Policy. We are not liable for issues caused by such third‑party services.

4.4 Background Remover and Uploaded Images

The Background Remover allows you to upload images for processing. By using this feature, you:

• authorize us to temporarily store your image in Supabase Storage and to issue a time‑limited, signed URL so that fal.ai can access and process your image;
• acknowledge that we delete the uploaded image from our storage promptly after processing completes; the processed result may be stored in your account;
• acknowledge that fal.ai may retain your image for at least seven (7) days and may use it for service improvement and AI model development, and may disclose it to third parties if legally required, under its own terms and privacy policy; and
• agree that we cannot guarantee confidentiality of any image sent to third‑party processors—do not upload sensitive or confidential content.

Prohibited uploads include: images with personal data or IDs, confidential or trade secret content, copyrighted/trademarked works without permission, privacy‑invasive identifiable photos, and content that is obscene, violent, discriminatory, or otherwise unlawful or objectionable.

You represent and warrant that you have all necessary rights to the images you upload and that your uploads do not violate laws or third‑party rights. We may remove content or suspend the feature to protect users and the Service.

5. Disclaimer of Warranties

We do not guarantee the accuracy, reliability, or completeness of the content generated by this tool. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the confidentiality of images transmitted to or processed by third‑party processors as part of the Background Remover feature. Do not upload sensitive or confidential information.

6. Limitation of Liability

We are not responsible for any damages or losses resulting from the use of this tool. This includes direct, indirect, incidental, consequential, or punitive damages arising from your access to or use of the Service.

7. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Generate content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Interfere with or disrupt the Service or servers connected to the Service
• Share credentials or enable others to access the Service through your account; pool or rotate accounts; or attempt to circumvent per-user/seat limits or fees
• Bypass payment requirements, create multiple accounts to evade limits, or use stolen or unauthorized payment methods
• Upload content to which you do not have rights; upload illegal content or content that infringes others’ privacy, publicity, or intellectual property rights when using the Background Remover

You agree not to upload the following when using the Background Remover:

• Images containing personal data or identification documents (e.g., ID cards, passports)
• Images containing confidential information or trade secrets
• Copyrighted or trademarked works without permission from the rights holder (e.g., branded characters, logos)
• Photos that could identify an individual in a privacy‑invasive manner
• Images that are obscene, violent, discriminatory, or otherwise contrary to public policy

8. Privacy

Any information collected through the Service will be handled in accordance with our Privacy Policy. By using the Service, you consent to such processing of your information.

We use Supabase for authentication and Stripe for payment processing; certain information is shared with these providers as necessary to operate the Service. See our Privacy Policy for details.

9. Termination

We reserve the right to terminate or restrict your access to the Service for any reason, including violation of these Terms, without prior notice.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
